General Terms and Conditions (T&C)
The Fine Print, with a Focus on You. Transparency is the foundation of every great photograph. Below, you’ll find the clear, simple rules that protect our creative collaboration—from how I handle your data to the rights you have over your images. No jargon, just professional standards to ensure we can focus on what matters: capturing your story.
Effective Date: January 27, 2026 (Updated Version)
1. Scope of Application
These T&C apply to all assignments, offers, and services provided by Jan Schick Photography. Any deviating conditions of the client are not recognized unless Jan Schick Photography expressly agrees to them in writing.
2. Services & Artistic Freedom
- Scope of Service: The scope is defined by the respective offer or booking confirmation.
- Artistic Freedom: The photographer is free in the artistic execution (lighting, composition, editing style). Complaints regarding the artistic style applied by the photographer are excluded.
- Post-Processing: Only edited images in the agreed format will be delivered. The release of unedited RAW files is generally excluded.
3. Booking, Deposit, and Payment
- Conclusion of Contract: A contract is formed upon written confirmation (email is sufficient) and payment of the agreed deposit.
- Deposit: The deposit secures the booking date and is non-refundable in the event of cancellation by the client (as compensation for lost booking opportunities).
- Late Payment: Invoices are due within 10 days. In the event of late payment, the photographer reserves the right to charge late fees and interest.
4. Cancellation and Rescheduling
Cancellation: If the client cancels, the following fees apply:
- Up to 30 days before the date: The deposit only.
- 30 to 7 days before the date: 50% of the total fee.
- Less than 7 days before the date: 80% of the total fee.
Rescheduling: Rescheduling is possible upon consultation but may incur a rescheduling fee.
5. Usage Rights & Copyright
- Copyright: Under Swiss law, copyright remains with the photographer at all times.
- Client Usage: The client receives a non-transferable license for private use. Any commercial use or modification of the images (e.g., through filters or cropping) requires written consent.
- Self-Promotion: Jan Schick Photography may use the resulting images for self-promotion (website, social media, portfolio) unless the client expressly objects at the time the contract is signed.
6. Liability and Force Majeure
- Limitation of Liability: Liability for damages is limited to intent and gross negligence. In the event of loss of digital material due to technical defects, the photographer’s liability is limited to the amount of the agreed fee.
- Photographer Absence: If the photographer cannot attend the appointment due to illness, accident, or force majeure, he will attempt to find a replacement photographer. If this is not possible, any payments already made will be refunded. Further claims for damages are excluded.
7. Data Protection & Jurisdiction
The privacy policy of Jan Schick Photography applies. Swiss law is applicable. The place of jurisdiction is Zug, Switzerland.
8. Special Terms for Collaborations (TFP)
For non-monetary collaborations (e.g., “Time for Print”), the following terms apply unless otherwise agreed in writing:
- Copyright & Attribution: Full copyright remains with Jan Schick Photography. For every publication (Social Media, websites, portfolio), Jan Schick Photography must be credited and tagged/linked (e.g., “Photo: @jan_schick” or a link to www.janschick.com).
- Agency Usage: Model agencies are permitted to use the images for the model’s portfolio/composite card but must strictly credit and link Jan Schick Photography as the creator.
- Commercial Use: Any use beyond self-promotion (e.g., sale to third parties, use in paid advertising, print media) is strictly prohibited and requires a separate commercial license and payment.
- Violation of Credit Requirements: If the credit/link is omitted or if unauthorized commercial use occurs, the “free” status of the collaboration is voided. In such cases, Jan Schick Photography reserves the right to invoice the usage at standard market rates (SAB rates). Further legal action remains reserved.
